ROCKDALE COUNTY, GA—Post 1 Commissioner Sherri Washington and Post 2 Commissioner Doreen Williams announced today the county’s plans to file a federal lawsuit this week against BioLab and its parent company, KIK.
“BioLab has had at least four instances of negligence in the 20 years that it has operated in this community,” said Washington. “At his point, their risk to our community far outweighs any benefit that we could possibly glean from their operation in this county. “…Today, we stand for the people. We stand for environmental justice. We stand for the future. By filing this lawsuit, we will prove that no corporation is above the law and no profit is worth the price of our community’s wellbeing.”
The Napoli Shkolnik PLLC law firm is filing the lawsuit in the Northern District of Georgia declaring BioLab a public nuisance and will seek damages on behalf of the county and citizens impacted by the Sept. 29 explosion. Shayna E. Sacs, a partner in the firm, addressed the media during today’s press conference outside of the Rockdale County Courthouse.
BioLab issued the following response around 4 p.m. on Oct. 21 concerning Rockdale County’s announced lawsuit:
“We have not seen the complaint yet and so it would be inappropriate for us to comment, other than to note that BioLab worked collaboratively with the County and other parties as part of the Unified Command to successfully complete the emergency response operations at our Conyers facility, while at all times prioritizing public health and safety. We also worked diligently alongside the County to quickly stand up support resources for community members – including a process to be reimbursed for expenses related to the incident – and we remain fully committed to making things right for impacted area residents and business owners.”
